Here
are two recent cases that underscore our competence in the area
of brain injury; Borgia v. Auranco, Inc. and Nguyen
v. Commerce Casino.
In
the first case, Borgia v. Auranco, Inc., a 25-year old
man was severely brain-damaged and his 40-year old sister was
seriously injured when the conversion van they were riding in
was hit in a head-on collision at 35 miles per hour. They were
seatbelted in a three-point harness. Upon impact both front seats
came off the seat rails and the seat belt webbing broke causing
them to strike the interior of the van. The driver of the other
vehicle sustained only minor injuries. Ed
Steinbrecher obtained a jury verdict of $35,000,000
against the seat pedestal manufacturer.
In
the second case, Nguyen v. Commerce Casino, a 54 year old
woman suffered brain injury after being hit by a shuttle bus in
the parking lot of the Commerce Casino. After the Casino offered
only $2.5 million dollars as a settlement, Ed
Steinbrecher chose to take the case to jury trial where the
jury found that the driver had indeed been negligent and awarded
the plaintiff $13,200,000 for her brain injury. "I
feel a lot of peace," the plaintiff's daughter said. "If
the verdict didn't come out as it did, I don't know how we would
have taken care of her."
